Having created the game theoretic framework of the present litigation and identified a settlement offer (or demand) that represents the best tradeoff between gain, wealth dispersion and settlement risk, litigants can then take an important final step. Using the OneShot™ function in LitigationSimulator, litigants can then literally simulate the experience of making a final offer or demand. LitigationSimulator then becomes a settlement simulator. The application statistically samples from the range of simulated potential outcomes and responds with an individual discrete outcome: “Settlement”, “Trial Win Value”, or “Trial Loss Value”.
This function quite literally puts the litigant in position of making a final offer or demand before actually “going final”. OneShot allows litigants to experience the consequences of their final settlement decision in the safety of a “settlement bargaining laboratory” before committing to a final number.
