SettlementAnalytics™ maintains an ongoing programme of research into litigation economics and settlement bargaining. While we actively review the academic literature for useful theoretical developments, our orientation is that of a practitioner, seeking to advance the application of economics, game theory and bargaining theory to the business of legal claims valuation and settlement bargaining. Our research interests therefore have an applied bent.
To this end we have launched two general research initiatives which we will be expanding in the coming weeks and months. These initiatives have different degrees of formality, but what they have in common is the goal of exploring and illuminating the areas of settlement bargaining that can provide the greatest analytic insight for litigants and their legal counsel.
Fundamentally, this work involves a comparison of our quantitative theoretical settlement bargaining models with actual bargaining behaviour. The key programmes can be briefly summarised as follows:
