We introduce the idea of Quantitative Settlement Bargaining Analysis™ (“QSBA”) as a new analytic discipline and process that serves to bridge the ‘computational gap’ between the economic analysis of trial and what that means for claim value, settlement and litigation risk.
QSBA starts where trial analysis ends. It takes the assumptions and expectations developed in preparing trial expected values, then augments these with considerations of uncertainty, information, contingency and the bilateral bargaining process to develop a more fulsome economic analysis of litigation as a whole. So armed, we believe litigants can make better legal-economic and settlement bargaining decisions.
